GDPR - when will we receive definitive guidance? The consultation on consent guidance by the European Article 29 Working Party, closed on 23 January 2018. Once this guidance has been formally adopted, the ICO will then finalise their own consent guidance. It is likely however, that the definitive guidance on consent will not change significantly from the draft guidance released last year. We are also expecting further information on legitimate interests to be added to the ICO’s Guide to the GDPR later this month. Whilst we await formal adoption of the guidance, the ICO has expanded the information available on its website, with further guidance in the lawful basis, consent and legitimate interests sections, and a frequently asked questions section for charities. There will be updated guidance on direct marketing released by the ICO later this year, and in the future, the Privacy and Electronic Communications Regulations (PECR) will be superseded by a new e-Privacy Regulation, but this has yet to be finalised at a European level and once agreed, the new e-Privacy regulation can be put into effect much sooner. |
